1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Vagabond Cove ("Vagabond Cove," "we," "us," or "our") governing your use of the Muse iOS application ("Muse" or "the app"). By downloading, installing, or using Muse, you agree to these Terms. If you do not agree, please do not use the app.
Muse is distributed through Apple's App Store. Your use of the App Store and the app is also subject to Apple's Licensed Application End User License Agreement (Apple Standard EULA) (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Where these Terms and the Apple Standard EULA address the same subject, these Terms supplement Apple's terms.
2. The app
Muse is a standalone iOS application that helps you track consistency in your creative practices — logging check-ins, tracking streaks, viewing stats, and watching your animated "Muse" reflect your creative momentum. Muse runs entirely on your device. There is no account, no login, and no Vagabond Cove server. If you enable iCloud, your data syncs privately through your own Apple iCloud account.
3. License
Muse is sold as a one-time purchase, not a subscription. Subject to these Terms and the Apple Standard EULA, Vagabond Cove grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of Muse on Apple devices that you own or control, as permitted by the App Store usage rules, for your own personal, non-commercial use.
This is a license, not a sale of the app itself. Vagabond Cove and its licensors retain all rights not expressly granted to you.
4. What you may not do
You agree not to:
Copy, modify, reverse-engineer, decompile, or disassemble the app, except to the limited extent applicable law expressly permits;
Rent, lease, lend, sell, redistribute, or sublicense the app;
Remove, obscure, or alter any proprietary notices;
Use the app in any unlawful manner or in violation of these Terms, the App Store usage rules, or the Apple Standard EULA.
5. Your content and data
The practices, check-ins, notes, and Muse customizations you create in the app are yours. They are stored on your device and, if you enable iCloud, in your personal iCloud account. Vagabond Cove does not collect, receive, access, or store this data. How information is handled is described in the Muse Privacy Policy, which is incorporated into these Terms by reference.
Because your data lives on your device and in your iCloud account, you are responsible for maintaining your own backups. Vagabond Cove is not responsible for any loss of data, including data lost due to device failure, deletion of the app, or interruption of iCloud service.
6. Purchases and payment
Muse is purchased through the Apple App Store. All payments, billing, and refunds are handled by Apple under Apple's terms; Vagabond Cove does not process payments and does not receive your payment information. Refund requests are subject to Apple's policies. Muse contains no subscriptions, in-app purchases, or advertising.
7. Intellectual property
The app, including its software, design, the Muse characters and animations, names, logos, the Vagabond Cove name and sigil, and all related content, is owned by Vagabond Cove or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to use Vagabond Cove's trademarks, branding, or character designs except as part of normal personal use of the app.
8. Updates
We may release updates, bug fixes, or improvements to Muse from time to time, distributed through the App Store. We are not obligated to provide any particular update, to maintain support for older versions or operating systems, or to keep any specific feature available indefinitely.
9. Disclaimer of warranties
To the fullest extent permitted by law, Muse is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Vagabond Cove does not warrant that the app will be uninterrupted, error-free, or that data sync will always succeed. You use the app at your own discretion and risk.
10. Limitation of liability
To the fullest extent permitted by law, Vagabond Cove will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) Muse. To the extent liability cannot be excluded, Vagabond Cove's total liability is limited to the amount you paid for the app.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable consumer-protection law.
11. Apple as third-party beneficiary
These Terms are between you and Vagabond Cove only, not with Apple. Apple is not responsible for the app or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you. Any maintenance, support, warranty, product-liability, or legal-claim obligations relating to the app are the responsibility of Vagabond Cove, not Apple, as further described in the Apple Standard EULA.
12. Termination
These Terms apply until terminated. Your license ends automatically if you fail to comply with them. You may end the agreement at any time by deleting the app. Upon termination, the license granted to you ceases, though the sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time, for example to reflect new features or legal requirements. When we do, we will revise the "Last updated" date above and post the current version at its published location. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of [STATE / COUNTRY — confirm], without regard to its conflict-of-laws principles, except where applicable consumer-protection laws of your place of residence require otherwise.
